IMPORTANT — READ BEFORE SIGNING. This agreement includes an assumption of risk, release of claims for ordinary negligence to the fullest extent permitted by New Jersey law, and indemnification obligations. It does not release gross negligence, recklessness, willful misconduct, fraud, or duties that cannot legally be waived.

Complete this form when requesting towing, recovery, winching, extraction, transport, loading, unloading, storage, or vehicle-release services. Disclose all known vehicle damage, modifications, mechanical problems, missing keys, locked wheels, low-clearance conditions, and property hazards.

Authority and Accuracy

I represent and warrant that I am the vehicle owner or have full authority from the vehicle owner, property owner, or authorized principal to request and approve the services identified above. All information and disclosures are complete and accurate. I authorize Chain Gang Towing & Recovery Agency, its employees, agents, contractors, and equipment operators (collectively, the “Released Parties”) to perform the requested services.

Assumption of Inherent and Disclosed Risks

I understand that towing, recovery, winching, extraction, loading, transport, storage, and vehicle-release services involve inherent risks of movement, shifting, scraping, component failure, leakage, and additional damage—especially for accident-damaged, disabled, locked, missing-key, flat-tire, low-clearance, modified, leaking, unstable, AWD/4WD, hybrid, or electric vehicles. I voluntarily assume these inherent and disclosed risks and accept responsibility for pre-existing damage and for conditions I fail to disclose.

Release of Claims Including Ordinary Negligence

To the fullest extent permitted by New Jersey law, I voluntarily, knowingly, and unequivocally release the Released Parties from claims for property damage, loss, or personal injury arising from the requested services, INCLUDING CLAIMS ALLEGING ORDINARY NEGLIGENCE BY THE RELEASED PARTIES. This release does not apply to gross negligence, recklessness, willful misconduct, fraud, or any duty or liability that applicable law prohibits from being waived.

Indemnification and Hold Harmless

I agree to indemnify, defend, and hold harmless the Released Parties from third-party claims, losses, liens, damages, costs, and reasonable attorneys’ fees arising from my lack of authority, false or incomplete information, undisclosed conditions, directions I provide, disputes with a vehicle or property owner, or the presence of people or personal property. This obligation does not require indemnification for conduct or liability that applicable law does not permit to be indemnified.

Personal Property, Photos and Insurance

I will remove valuables and understand that personal property is not inventoried unless confirmed in writing. I authorize reasonable photographs or video of the vehicle, equipment, property, and service conditions for documentation. I am responsible for maintaining applicable insurance and will report any claimed damage promptly, before leaving or vehicle release when practical.

Entire Agreement, New Jersey Law and Electronic Signature

I have read and understand this agreement, had an opportunity to ask questions or decline service, and sign voluntarily. No oral statement changes this agreement. New Jersey law governs; any unenforceable provision will be limited or severed while the remainder continues. By typing my name and submitting this form, I intend to provide an electronic signature and agree that the electronic record has the same force as a handwritten signature.
